In a planned unit development where ownership is subject to restrictions, the subdivision plat, dedications, covenants, and other agreements shall be recorded in the office of the county clerk and recorder. These documents will also include those that:

A. Create automatic membership in a nonprofit home- owners’ association or corporation to be formed to control, develop, and maintain common areas, properties, and facilities;

B. Place title to any common property or facilities in the association or corporation. (Ord. 523 § 1(part), 1989)
