12.32.030 Permit-Issuance.

No such permit shall be issued unless and until the applicant therefor has filed with the city clerk a bond in the sum of five thousand dollars conditioned to indemnify the city for any loss, liability, or damage that may result or accrue from or because of the making, existence, or manner of guarding or constructing any such tunnel or excavation. Such bond shall be further conditioned to fill up, restore, and place in good and safe condition as near as can be its original condition and to the satisfaction of the superintendent of public works, all openings and excavations made in streets, alleys, sidewalks, and other public grounds and to maintain any street, alley, sidewalk, or other public grounds where excavation is made in as good condition for a period of twelve months after the work has been done, usual wear and tear excepted, as it was before such work shall have been done, if the backfill for such excavation is mechanically compacted by accepted methods, or if not so compacted, then to maintain the same for a period of twenty-four months in such good condition.
