Chapter 10.12 ENFORCEMENT AND OBEDIENCE
10.12.060 Violation--Penalty.
Unless another penalty is expressly provided by law, every
person convicted of a violation of any of the provisions of this title shall,
for a first conviction thereof be punished by a fine not less than ten dollars
nor more than one hundred dollars or by imprisonment for not more than ten days.
For a second conviction within one year thereafter, the person shall be punished
by a fine of not less than twenty-five dollars or more than two hundred dollars
or by imprisonment for not more than twenty days or both such fine and
imprisonment. Upon a third or subsequent conviction, within one year after the
first conviction, the person shall be punished by a fine of not less than fifty
dollars nor more than five hundred dollars or by imprisonment for not more than
six months or both such fine and imprisonment.
A. On failure of the payment of a fine, the offender, in case
of a misdemeanor, shall be imprisoned in the city jail, which imprisonment shall
be computed on the basis of one day’s incarceration for each two dollars
of the fine.
B. Upon conviction, the court costs or any part thereof may
be assessed against the defendant, in the discretion of the court. (Ord. 474
