A. A person convicted of the offense of disseminating obscene material as defined in this chapter shall be for the first offense fined one hundred dollars; for the second offense fined two hundred fifty dollars and imprisoned in the county jail for a period of three months; for the third offense fined five hundred dollars and imprisoned in the county jail for six months.

B. For the purposes of this section an "offense" means the act of transferring, distributing, dispensing, etc., regardless of the amount of material transferred, distributed, dispensed, etc., at each act. (Ord. 382 § 3, 1979)
